Expungement
Expungement is a general term used to describe the removal of information from a criminal record to allow an ex-felon to live more comfortably. This is usually accomplished through the deletion or sealing of information. Expungement can make life easier by:
  • Providing a past felon closure
  • Allowing a past felon to legally answer no to a potential employer or other background checker when asked if he/she has been convicted of a felony
  • Allowing a past felon to become eligible for a broader range of training certificates and professional licenses
  • Allowing a past felon to become eligible for student loans
  • Allowing a felon to become eligible for housing assistance

Depending on the jurisdiction, those who qualify for expungement may include:
  • Individuals who have been convicted of a misdemeanor or felony for more than a year (excludes sex offenders)
  • Those who have met the conditions of their probation
  • Those who have been released from a county prison (excludes state prisoners)
  • Individuals who were charged, but never convicted of a misdemeanor or felony
  • Those found not guilty or had the charges against them dropped
